Seller agreement with Waiver of Liability

Thank you for choosing to sell with Later Gator Sales!  In order to make our sale a success the following guidelines have been implemented.

  1. Later Gator Sales will offer all sellers pricing their own items 60% of the selling price. Selling prices are determined by the seller. Sellers can receive up to 80% on their merchandise by donating their time volunteering with the sale.  

  2. Sellers are required to pay a $15 registration fee that is non-refundable and non-transferable.   The seller registration fee paid to Later Gator Sales is an acknowledgement of and acceptance of these terms and conditions.

  3. Sellers will be responsible for preparing all merchandise for the selling floor according to guidelines set by Later Gator Sales. This prep includes, but is not limited to, washing, spot treating, placing on hangers, providing working batteries for electronics, using our online tagging system to create price tags on cardstock, properly attaching tags, etc. Sellers will be required to assemble large items on site. This may include, but is not limited to, cribs, playsets, outdoor toys, nursery furniture, bed frames, etc.

  4. We will allow every seller 10 "no thank you" items.   After 10 "no thank you" items we will charge additional fees. This will be deducted from your seller payment.   Please review the guidelines for selling for a breakdown of fees that will be assessed.

  5. Sellers will be limited to a maximum of 500 tagged items per $15 registration fee. Within this maximum, up to 150 infant clothing items (sizes newborn-18 mos) will be accepted. Please be advised that selling with Later Gator Sales does not guarantee the sale of items.

  6. Later Gator Sales does not allow more than one person to tag under the same seller number. If Later Gator Sales discovers that more than one person is tagging under the same seller number, a $15 seller fee will be assessed for each person.

  7. Later Gator Sales reserves the right to to sell any items that are missing a tag using commonly used prices for that item.

  8. I understand that my items will be safeguarded as best as possible against theft; I will not hold Later Gator Sales responsible for any items that are missing. I sell with full knowledge that theft/shoplifting may happen and Later Gator Kids Sales will not reimburse me for any of these items, should theft/shoplifting happen to my consigned items.

  9. Later Gator Sales is not responsible for items damaged or destroyed during any point of the sale process, including check-in or pick-up. This includes fire, loss, theft or damage to items.

  10. Later Gator Sales reserves the right to pull any items from the selling floor that do not meet requirements for our sale.  Each seller is responsible for ensuring items are not on any recall lists. If an item is sold and found to be recalled within 3 days of sale end, the seller will be required to refund the buyer. In this case, the refund will be deducted from seller payment issued from Later Gator Sales.

  11. Any items not picked up within the designated pick up period will be immediately placed for charity pick up even if they were not designated for donation by the seller. Items that are designated for donation and placed on the selling floor will not be returned to the seller. All sellers with donated merchandise can access a document for their tax purposes using their online seller account.

  12. Following designated seller pick up times after the sale, no items will be held or stored by Later Gator Sales. There will be no exceptions.  

  13. Sellers will receive payment for their sold items within 2 weeks of our sales event (we do our best to get them out sooner than the end of the 2 week time period).  Earnings will be automatically deposited into the seller’s PayPal account. Later Gator Sales will cover the PayPal fees so there will be no additional cost to the seller to use PayPal. The email you use for registration with Later Gator Sales needs to be the same email you use for PayPal or should be linked to your PayPal account.

  14. Sellers who do not have a PayPal account can set one up prior to the sale, or by following directions received from PayPal once we submit your payment through PayPal.

  15. Sellers who choose not to create a PayPal account & accept the funds via PayPal, will have funds returned to Later Gator Sales 30 days after we send your initial payment.   Later Gator will issue a check (by mail) within 5 business days after the funds are returned to Later Gator from PayPal. There will be a $3.00 processing fee deducted from your earnings to cover the extra processing fees. 

  16. Later Gator Sales reserves the right to ban sellers from selling through Later Gator for inappropriate conduct toward our Volunteers/Coordinators/Owners. Registration fees will not be refunded.

  17. Later Gator Sales, the event location, the insurer of Later Gator Kids Consignment Sales, and any other affiliated party will not be responsible for personal injury resulting from participation in drop off, selling periods and pick up activities.  

If a Clause of this Agreement is determined by any court or other competent authority to be unlawful and/or unenforceable, the other Clauses of this Agreement will continue in effect.
